Guidelines for Name, Image, and Likeness
ÂUNC Asheville student-athletes may earn compensation for the use of their name, image, or likeness under the following guidelines until the State of North Carolina passes a law with clear policies.

University Photo Release. All student-athletes will be required to sign the University photo release form as a condition of participation in intercollegiate athletics. This release gives UNC Asheville the authority to use photographic images and comments as promotional materials, whether the use of above materials be for public relations, recruitment, development, or any other legitimate purpose of UNC Asheville Athletics.

Disclosure of Name, Image and Likeness Activities. A student-athlete shall disclose all name, image and likeness activities, including information related to transactions, compensation arrangements and details of relationships with an involved individual, commercial entity and third parties (e.g., contact information, identification of role). Activities include both cash transactions and gift in kind type activities. All disclosures will take place through the INFLCR app. Any student-athlete planning to engage in NIL activities should download and maintain the app for proper disclosure.

Pay-for-Play Prohibited. Compensation earned by student-athletes for the use of their name, image, or likeness must represent a genuine payment for the use of their name, image, or likeness, independently of, rather than as a payment for, their athletic participation or performance, or attendance at an institution. The compensation shall be commensurate with the market value of the student-athlete’s name, image, or likeness.

Institutional Involvement. An institution shall not be involved in the development, operation or promotion of a non-institutional name, image and likeness activity and shall not purchase a student-athlete’s work product or service. A product or service that is developed as part of a student-athlete’s coursework is not subject to these restrictions.

Boosters. An institution may not use or allow boosters to directly or indirectly create or facilitate compensation opportunities for the use of a student-athlete’s name, image, or likeness as a recruiting inducement or as a means of paying for a student-athletes participation.

Use of Institutional Facilities/ Marks. Any student-athlete may not use the institution’s facilities, uniforms provided by the institution, or the institution’s intellectual property, including, but not limited to, the unauthorized use of a registered trademark or product protected by copyright, in connection with the use of the student-athlete’s name, image, or likeness activities.

When NIL Activities May Occur. Activities related to a student-athlete’s use of his name, image, or likeness for compensation are prohibited from taking place during the student-athletes participation in academic, athletic, or team-mandated activities as defined by the UNC Asheville Athletics department.

Prospects. Activities related to name, image, or likeness for compensation can not be used as an inducement for participation and enrollment by a prospective student-athlete. All UNC Asheville coaches who are certified to recruit are expected to educate prospective student-athletes about the NIL guidelines of UNC Asheville prior to their written offer of aid to the University.

Professional Service Provider. Obtaining a professional service provider for the purpose of securing compensation for the use of name, image, or likeness is permissible.

Specifically Prohibited Promotional Activities. A student-athlete shall not engage in name, image and likeness activities involving a commercial product or service that conflicts with NCAA legislation (e.g., sports wagering, banned substances) or are contrary to the values that UNC Asheville upholds. A student-athlete may not enter into an agreement that conflicts with an existing institutional sponsorship without permission for the institution.

   11. Opportunities for Name, Image, or Likeness. Student-athletes are able to earn compensation through a variety of sources including but limited to social media, personal appearances, private lessons or camps, and endorsement deals.
